PAJAK merupakan kontribusi wajib oleh orang pribadi atau badan kepada negara yang menjadi salah satu sumber pendapatan negara, supaya dapat membantu negara dalam melakukan pembangunan, dengan tujuan memberikan kesejahteraan bagi rakyat Indonesia. Pada sektor pertambangan, negara mendapatkan penerimaan dari pajak penghasilan (PPh) Pasal 25 untuk badan.
Selain penerimaan dari pajak penghasilan badan, negara juga mendapatkan dari pajak penghasilan Pasal 21 untuk gaji karyawan, pajak penghasilan Pasal 23 untuk jasa yang menunjang kegiatan pertambangan, pajak penghasilan Pasal 4 ayat 2 untuk jasa konstruksi dan sewa lahan atau tanah, pajak penghasilan Pasal 15 untuk jasa pengangkutan melalui perairan. Pajak penghasilan Pasal 22 untuk bisnis ekspor-impor, pajak pertambahan nilai (PPN) untuk barang kena pajaknya adalah batu bara yang telah diolah menjadi briket, serta pajak bumi dan bangunan (PBB) untuk objek pajaknya adalah areal penambangan.
Indonesia termasuk dari sepuluh produsen pertambangan terbesar di dunia. Sehingga tidak heran, jika sektor pertambangan merupakan salah satu penyumbang penerimaan negara terbesar di Indonesia. Setidaknya 65% hingga 70% penerimaan negara berasal dari sektor pertambangan, menurut Hendra Sinadia selaku Direktur Eksekutif Asosiasi Pengusaha Batu Bara Indonesia (APBI).
Namun sayangnya, kontribusi pajak dari sektor pertambangan tergolong minim. Data yang diterbitkan oleh Kementrian Keuangan menunjukkan bahwa tax ratio dari sektor pertambangan mineral dan batu bara sekitar 2,6% sementara tax ratio nasional sebesar 10,6%. Rendahnya tax ratio ini dipengaruhi oleh salah satunya adalah penghindaran pajak yang dilakukan oleh wajib pajak.
Menurut KPK, telah terjadi kekurangan pembayaran pajak tambang di kawasan hutan sebesar Rp 15,9 triliun per tahun. Walaupun beberapa pihak beranggapan bahwa secara hukum, penghindaran pajak adalah legal untuk dilakukan. Namun Direktorat Jendral Pajak menilai, penghindaran pajak dapat merugikan negara.
Pada masa pandemi yang tengah terjadi di global, menurut Direktorat Jenderal Pajak (DJP), Kementrian Keuangan, penerimaan pajak dari sektor pertambangan mengalami penurunan sebesar 14%. Beberapa penyebabnya adalah harga jual batu bara yang anjlok karena terjadi oversupply dan adanya kebijakan lockdown di beberapa negara yang membuat aktivitas perekonomian terpaksa terhenti, sehingga terjadi penurunan ekspor batu bara, khususnya ekspor ke India menurun sekitar 20% dan membuat pengusaha di sektor pertambangan mengalami penurunan kemampuan dalam pembayaran pajak. Hal ini dapat membuka celah baru untuk wajib pajak melakukan penghindaran pajak.
Salah satu upaya pemerintah Indonesia adalah memberikan keringanan untuk wajib pajak dengan menerbitkan Perppu No. 1 Tahun 2020, salah satunya membahas mengenai perubahan tarif pajak peghasilan badan yang semula sebesar 25% menjadi 22% pertahun 2020 hingga 2021. Kemudian menurut Sri Mulyani, untuk tahun 2022 tarif pajak penghasilan badan akan diturunkan lagi sebesar 2%, yaitu menjadi 20%.
Selain menjadi upaya untuk penghindaran pajak bagi wajib pajak, kebijakan ini juga untuk menghadapi ancaman yang membahayakan stabilitas perekonomian nasional akibat pandemi Covid-19. Dengan diterbitkannya kebijakan tersebut, diharapkan tidak menjadi celah baru bagi wajib pajak untuk membayarkan pajaknya. Dan para wajib pajak khususnya di sektor pertambangan diharapkan dapat ikut berkontribusi dengan membayar pajak tepat waktu. Supaya dapat membantu pemerintah dalam pembangunan negara dan dapat membanu menstabilitaskan perekenomian nasional.
