Mantan Lurah Perdagangan I Diduga Terlibat dalam Pemalsuan Dokumen Tanah

DUGAAN pemalsuan surat pernyataan ahli waris atas lahan sawah di Kecamatan Bandar, Kabupaten Simalungun, Sumatera Utara, menjadi sorotan publik. Pasalnya, kasus tersebut menyeret aparatur sipil negara (ASN), yakni mantan Lurah Perdagangan I berinisial GN yang kini menjabat sebagai Sekretaris Camat di Kecamatan Tapian Dolok, Kabupaten Simalungun.

Kasus dugaan pemalsuan surat pernyataan ahli waris tersebut sudah dilaporkan ke Polres Simalungun karena diduga melanggar Pasal 263 KUHP. Silahkan simak juga video wawancara jurnal-investigasi.com dengan Kasat Reskrim Polres Simalungun, AKP Rachmat Ariwibowo.

Menurut penelusuran jurnal-investigasi.com, dugaan pemalsuan surat pernyataan ahli waris itu terjadi disebabkan tidak lengkapnya data anggota keluarga sebenarnya yang dicantumkan dalam surat yang diteken GN.

Berikut petikan wawancara wartawan jurnal-investigasi.com, Anastasia Rita, saat mewawancarai GN untuk mendalami kasus dugaan pemalsuan dokumen tersebut, beberapa waktu lalu.

Bagaimana kronologis penerbitan surat keterangan ahli waris yang Ibu tanda tangani dan telah dilaporkan ke Polres Simalungun sebagai dugaan pemalsuan dokumen?

Itu kan sudah dipanggil Polres kemarin, semua yang berkompeten yang bersangkutan dengan penerbitan surat tanah itu. Sudah dipanggil, sudah berapa kali dipanggil itu sebagai saksi. Semua sudah dipanggil. Karena itu, dugaan pemalsuan surat itu lokasinya pada saat diketahui adanya pemalsuan surat itu di Nagori Bandar yang dibuat Penghulu (Kepala Desa) Nagori Bandar atas nama WS.

Kan ada itu lengkap dengan tanggal, bulan, dan tahunnya. SKP-nya itu di Nagori Bandar. Jadi, alangkah baiknya kalau mewawancarai atau bertanya, ke penghulu yang bersangkutan. Karena itu pun, semua sudah dipanggil ke Polres. Saya ada lengkap surat pemanggilannya tanggal berapa, tanggal berapa, dan saya menghadirinya.

Siapa saja pihak-pihak yang mengajukan penerbitan surat keterangan ahli waris tersebut?

Sebenarnya ahli waris itu kan yang diketahui palsu adalah ahli waris dari Nagori Bandar untuk penerbitan surat tanah. Objek tanahnya di Nagori Bandar dan ahli waris yang diterbitkan dari Kelurahan Perdagangan I sama sekali tidak dipakai almarhum atas nama DS dengan keturunannya. Yang dipakai mereka adalah ahli waris dari Nagori Bandar. Begitu ceritanya.

Karena datang penghulu, diterbitkannya ahli waris dari Nagori Bandar berdasarkan ahli waris dari Perdagangan I. Tapi, yang jelas, ahli waris dari Perdagangan I sama sekali tidak dipakai. Tapi, sudah lebih bagus bertanya ke Penghulu Nagori Bandar, Bapak WS. Karena itu, diketahui adanya penerbitan surat palsu ahli waris atas nama almarhum DS itu. TKP-nya di Nagori Bandar pada 2018 kalau tidak salah. Makanya, untuk lebih lengkap lagi, tanyakan ke Polres saja. Coba ditanya aja ke Pak Sitio dan Pak Siahaan. Pada saat itu kan Reskrimnya Bapak Jerico Lavian Chandra.

Lalu, bagaimana tanggapan Ibu terkait dengan proses hukum yang sekarang sedang berjalan di Polres Simalungun?

Karena kita kan pada saat itu menjabat selaku pemerintah di wilayah tersebut di kelurahan. Memang kita pemerintah ya. Datang warga bermohon, “Saya ingin membuat ahli waris, Bu”. “Kami sekian bersaudara, Bu,” katanya.

Ya, namanya melayani, kita kerjakan betul kan ahli warisnya. “Hanya segini jumlahnya?” kan kita tanya. “Ya, Bu. Kami hanya sekian orang”. Kan ada pernyataan mereka, pernyataan dari ahli waris yang membuat surat keterangan ahli waris itu, kan jelas tercantum.

Apabila kami memberikan keterangan di luar daripada yang kami berikan pada saksi, apabila kami memberi keterangan palsu, kami bersedia dituntut sesuai dengan peraturan hukum yang berlaku tanpa melibatkan pemerintah Kelurahan Perdagangan I, Kecamatan Bandar, Kabupaten Simalungun, kan seperti itu.

Kan mereka buat pernyataan, mereka menuangkan. Jadi, letak tanggung jawab semua sama almarhum, keluarga dari almarhum keturunannya. Karena jelas-jelas di sini tertulis, ‘Kami tidak akan melibatkan apabila kami memberikan keterangan palsu,’ kan itu. Kita di bawah hanya mengetahui Kepala Kelurahan Perdagangan I, kan seperti itu.

Pada saat mereka datang bermohon untuk membuat ahli waris, kita akan melampirkan surat pernyataan dari mereka yang menyatakan bahwasanya hanya kamilah anak dari almarhum ini. Di luar daripada itu, tidak ada. Apabila kami memberikan keterangan palsu di luar daripada ini, yang di atas kami bersedia menerima yang memberi pernyataan semua anak-anaknya, lalu dihubungkan dengan materai.

Namun, di sini Ibu yang menandatangani dan menerbitkan surat keterangan ahli waris tersebut?

Iya saya terbitkan, tapi berdasarkan pernyataan dari keturunan almarhum. Kan surat keterangan. Surat keterangan ahli waris kan itu ada dua jenis. Surat keterangan ahli waris ada lampirannya juga. Surat pernyataan ahli waris kan itu. Tapi yang jelas, ya sederhana sajalah, surat keterangan itu kan bukan itu yang dipersoalkan sebenarnya, bukan yang dari Kelurahan Perdagangan I.

Yang dipersoalkan, surat keterangan ahli waris yang diterbitkan Penghulu Nagori Bandar karena jelas-jelas itu yang diajukan. Enggak ikut surat panggilan dari Polres, saya dipanggil kan jadi saksi. Ya itulah yang ditanya, tanyakanlah ke penghulunya. Sudah dua kali saya dipanggil Polres dan saya hadiri kok.

Ya memang saya mengakui saya menerbitkan surat keterangan ahli waris berdasarkan pernyataan keturunan dari almarhum atas nama DS. Datang menghadap saya ke kantor. Setelah itu, memang mereka tidak ada memakai ahli waris itu, jelas tidak ada dipergunakan, dan mereka melanjutkan menerbitkan ahli waris lagi.

Nah, di situ letak kesalahan penghulunya. Seharusnya itu ahli waris yang dipakainya dari saya, tapi yang dipakai ahli waris yang tersedia. Yang jelas-jelas almarhum itu beralamat di Perdagangan I, tapi bukan itu yang dipakainya. Yang dipakai keturunan dari almarhum itu surat keterangan ahli waris dari Nagori Bandar untuk jual-beli tanah. Jadi, seperti itu ya.

Okelah boleh dihubung-hubungkan dengan saya, tapi enggak ada kok dipakai mereka. Itu sudah kena berapa kali kesalahan penghulunya, kenapa bisa diterbitkan surat keterangan ahli waris lagi. Jelas-jelas almarhum itu beralamat di Kelurahan Perdagangan I.

Ahli waris itu diterbitkan apabila seseorang yang alamatnya kan menentukan dan memang itunya objek sengketa. Itu ada suratnya kok. Tidak ada dituntut surat keterangan ahli waris saya dari Kelurahan Perdagangan I dan saya dipanggil polisi pun ya itu tanya-jawab atas adanya dugaan penerbitan surat keterangan ahli waris.  (J1)
