DIREKTORAT Jenderal Perlindungan Konsumen dan Tertib Niaga (Ditjen PKTN) dan Badan Pengawas Berjangka Komoditi (Bappebti) Kementerian Perdagangan (Kemendag) bertindak tegas terhadap usaha penjualan expert advisor atau robot trading tak berizin untuk melindungi masyarakat dari investasi ilegal. Tindakan tegas dilakukan kepada PT DNA Pro Akademi, Jumat (28/1), di Jakarta.
“Kegiatan penertiban ini merupakan hasil temuan pengawasan terhadap PT DNA Pro Akademi yang telah menjalankan kegiatan usaha penjualan expert advisor atau robot trading dengan menggunakan sistem MLM atas dasar legalitas berupa nomor induk berusaha (NIB) dengan Klasifikasi Baku Lapangan Usaha Indonesia 47999 (perdagangan eceran bukan di toko, kios, kaki lima, dan los pasar lainnya) yang belum berlaku secara efektif, terverifikasi, atau tidak memiliki izin usaha penjualan langsung,” ujar Direktur Jenderal PKTN Veri Anggrijono pada kesempatan terpisah.
Sementara itu, Direktur Tertib Niaga Sihard Hadjopan Pohan menjelaskan, berdasarkan ketentuan Peraturan Pemerintah Nomor 5 Tahun 2021 tentang Penyelenggaraan Perizinan Berusaha Berbasis Risiko, kegiatan usaha penjualan langsung termasuk dalam kategori risiko tinggi.
“Pelaku usaha penjualan langsung yang tidak memiliki perizinan berusaha dapat dikenai ketentuan pidana. Hal ini sesuai dengan ketentuan dalam Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja Sektor Perdagangan,” tutur Pohan.
Plt Kepala Bappebti Indrasari Wisnu Wardhana juga mengimbau kepada masyarakat agar lebih berhati-hati dalam melakukan investasi di bidang perdagangan berjangka komoditi.
“Masyarakat dapat melakukan pengecekan legalitas pelaku usaha di www.bappebti.go.id, sedangkan para pelaku usaha diharapkan dapat mematuhi ketentuan dalam Undang-Undang Nomor 10 Tahun 2011 tentang Perubahan Undang-Undang Nomor 32 Tahun 1997 tentang Perdagangan Berjangka Komoditi,” ungkap Wisnu.
Kepala Biro Peraturan Perundang-Undangan dan Penindakan Bappebti Aldison menambahkan tindakan pengamanan ini diharapkan dapat memberikan efek jera kepada pelaku usaha yang tidak taat ketentuan dan memberikan contoh lainnya agar menjalankan kegiatan mereka sesuai dengan aturan.
“Kegiatan ini juga dilakukan oleh Kemendag sebagai anggota Satuan Tugas (Satgas) Waspada Investasi untuk menindaklanjuti keputusan Satgas yang telah melarang kegiatan usaha PT DNA Pro Akademi pada Januari 2022,” imbuhnya. (RLS/J1)
