Demikian disampaikan Jaksa Agung lewat pesan whatsapp massanger kepada jurnal-investigasi.com, pada Rabu (3/7), dalam menanggapi tudingan dari aktivis Komunitas Pemuda Pemberantas Korupsi, Alfonsius, terkait lelang 102.930 slop rokok ilegal oleh Kejaksaan Negeri Tanjung Balai Karimun yang diduga melanggar Peraturan Menteri Keuangan (PMK) Nomor 136/PMK.04/2010.
Lebih lanjut Jaksa Agung mengatakan, perkara tersebut ialah perkara kepabeanan dan putusan Pengadilan Negeri Tanjung Balai Karimun terhadap barang bukti adalah dirampas untuk negara.
Karena perkara tersebut sudah inkracht (berkekuatan hukum tetap), kata Jaksa Agung, maka Kejaksaan Negeri Tanjung Balai Karimun melelang barang bukti tersebut sesuai amanat putusan.
Sementara itu, saat jurnal-investigasi.com menanyakan bunyi petikan putusan Pengadilan Negeri Tanjung Balai Karimun, yakni ‘Dirampas untuk dimusnahkan muatan KLM Bahtera Bahari Sejahtera berupa rokok merk RMX sebanyak 1.050 karton atau sebanyak 16.800.000 batang, rokok merk RMX sebanyak 130 slop atau sebanyak 26.000 batang, dan rokok merk Harmoni sebanyak 235 karton atau sebanyak 3.008.000 batang, Jaksa Agung mengatakan Kejaksaan Negeri Tanjung Balai Karimun melaksanakan pelelangan sesuai diktum putusan.

(Dirampas untuk negara) Diktum putusan itulah yang mestinya dijadikan dasar untuk harus dilaksanakan. Agar dipahami,” tulis Jaksa Agung dalam pesan whatsapp massanger kepada jurnal-investigasi.com.
Sebelumnya, dalam artikel bertajuk ‘Lelang Rokok Ilegal, Kejaksaan Negeri Tanjung Balai Karimun Diduga Tabrak Peraturan Menteri Keuangan’, aktivis dari Komunitas Pemuda Pemberantas Korupsi, Alfonsius, mengatakan pelelangan sebanyak 102.930 slop rokok ilegal oleh Kejaksaan Negeri Tanjung Balai Karimun melalui Kantor Pelayanan Kekayaan Negara dan Lelang (KPKNL) Batam, diduga bertentangan dengan PMK Nomor 136/PMK.04/2010.
Dia mengatakan, PMK 136/PMK.04/2010 tentang Tata Cara Penyelesaian Barang Kena Cukai dan Barang-Barang Lain yang Dirampas untuk Negara atau Dikuasai Negara, secara tegas mengatur bahwa barang kena cukai yang dirampas negara harus dimusnahkan oleh pejabat Bea dan Cukai.
Namun, hal yang terjadi justru sebaliknya. Melalui surat pengumuman lelang nomor: Peng-1379/L.10.12/Cu.3/06/2019 yang ditandatangani Ketua Panitia Lelang, Jaksa Pratama Arie Prasetyo, menyatakan sebanyak 102.930 slop rokok sigaret kretek mesin (SKM) dilelang di muka umum dengan limit harga sebesar Rp488.917.500.
Berdasarkan informasi yang diperoleh dari masyarakat, jelas Alfonsius, perampasan sebanyak 102.930 slop ilegal itu berawal dari penegahan yang dilakukan petugas Bea dan Cukai dari Kantor Wilayah Tanjung Balai Karimun pada Oktober 2018 silam.
Saat itu, petugas Bea dan Cukai mencurigai sebuah kapal KM Bahtera yang mengangkut ribuan slop rokok. Setelah ditegah, terungkap rokok-rokok ilegal tersebut diekspor dari Thailand dengan tujuan Singapura.
