Ini Penjelasan Sinergi BPJPH, LPH, dan MUI dalam Sertifikasi Halal

TERDAPAT perubahan mendasar dalam proses sertifikasi halal pascaterbitnya Undang-Undang No 33 Tahun 2014 tentang Jaminan Produk Halal. Salah satunya, proses sertifikasi halal dilakukan melalui sinergi para pihak, tidak hanya Majelis Ulama Indonesia (MUI).

Kepala Badan Penyelenggara Jaminan Produk Halal (BPJPH) Kementerian Agama (Kemenag) Muhammad Aqil Irham menjelaskan bahwa setidaknya ada 3 pihak yang terlibat dalam proses sertifikasi halal sebuah produk yang diajukan para pelaku usaha.

“Ada 3 aktor yang diatur dalam UU No 33 Tahun 2014 yang terlibat dalam proses sertifikasi halal, yaitu BPJPH, Lembaga Pemeriksa Halal (LPH), dan MUI,” jelas Aqil Irham di Jakarta, Selasa (15/3).

Menurutnya, tiap-tiap pihak sudah memiliki tugas dan tanggung jawab dalam tahapan sertifikasi halal sejak pengajuan pemilik produk hingga terbitnya sertifikat. BPJPH, misalnya, memiliki tugas menetapkan aturan atau regulasi, menerima, dan memverifikasi pengajuan produk yang akan disertifikasi halal dari pelaku usaha (pemilik produk), serta menerbitkan sertifikat halal beserta label halal.

Sementara itu, LPH bertugas melakukan pemeriksaan dan/atau pengujian kehalalan produk yang diajukan untuk sertifikasi halalnya. Pemeriksaan ini dilakukan auditor halal yang dimiliki LPH.

Pihak ketiga yang berperan dalam proses sertifikasi halal, kata Aqil Irham, ialah MUI. MUI berwenang menetapkan kehalalan produk melalui sidang fatwa halal. Ketetapan halal ini, baik yang terkait dengan standar maupun kehalalan produk.

“Sertifikat halal yang diterbitkan BPJPH didasarkan atas ketetapan halal MUI,” tegasnya.

Kepala Pusat Registrasi Sertifikasi Halal BPJPH Mastuki menambahkan, dalam pola sinergi ini, BPJPH tidak bisa mengeluarkan Sertifikat Halal kalau tidak ada ketetapan halal dari MUI (melalui sidang fatwa). Itu karena ketetapan halal MUI merupakan pemenuhan aspek hukum agama (syariat Islam), sedangkan sertifikat halal yang diterbitkan BPJPH ialah bentuk pengadministrasian hukum agama ke dalam hukum negara.

“Label Halal Indonesia baru bisa dicantumkan dalam kemasan produk setelah mendapat Sertifikat Halal dari BPJPH,” tandasnya.

Mastuki menjelaskan bahwa saat ini ada 3 LPH yang telah menjalankan tugas dalam melakukan kegiatan pemeriksaan dan pengujian kehalalan produk di dalam proses sertifikasi halal. Ketiganya ialah LPH LPPOM MUI, LPH Sucofindo, dan LPH Surveyor Indonesia.

Selain itu, ada 9 institusi yang pengajuan akreditasi mereka sudah lengkap dan terverifikasi menjadi LPH. Mereka, yakni Yayasan Pembina Masjid Salman ITB, Bandung; Balai Pengembangan Produk dan Standardisasi Industri Pekanbaru, Riau; Dewan Pengurus Pusat Hidayatullah, Jakarta; Kajian Halalan Thayyiban Muhammadiyah, Jakarta; Balai Sertifikasi Direktorat Standardisasi dan Pengendalian Mutu Kementerian Perdagangan; Universitas Hasanuddin Makassar; Yayasan Bersama Madani Koto Tangah,

Padang, Sumatra Barat; Universitas Brawijaya, Malang, Jawa Timur; dan Universitas Syiah Kuala, Banda Aceh. Dari jumlah itu, sebanyak 8 institusi sudah selesai proses integrasi sistem, sedangkan sisanya masih dalam proses.

“BPJPH telah membentuk tim Akreditasi LPH sejak 10 November 2021 untuk memproses permohonan tersebut,” jelas Mastuki.

“Sejumlah Perguruan Tinggi Keagamaan Islam Negeri (PTKIN) juga sudah mulai mengajukan permohonan untuk menjadi LPH,” tandasnya. (RLS/J1)
