MENTERI Ketenagakerjaan (Menaker) Ida Fauziyah menerima sejumlah pimpinan Serikat Pekerja (SP) atau Serikat Buruh (SB) untuk berdialog terkait dengan terbitnya Peraturan Menteri Ketenagakerjaan (Permenaker) Nomor 2 Tahun 2022 tentang Tata Cara dan Persyaratan Pembayaran Manfaat Jaminan Hari Tua (JHT) di Jakarta, Rabu (16/2). Dialog tersebut dihadiri Konfederasi Serikat Buruh Seluruh Indonesia (KSBSI) dan Konfederasi Serikat Pekerja Indonesia (KSPI).
Dalam dialog itu, Ida menjelaskan secara gamblang terkait dengan latar belakang keluarnya Permenaker 2/2022, tujuan dan maksud, serta hal-hal yang berhubungan Jaminan Hari Tua (JHT) dan Jaminan Kehilangan Pekerjaan (JKP).
“Jika flashback, ketika Permenaker 19/2015 diberlakukan saat itu, kita belum memiliki alternatif skema Jamsos bagi pekerja yang kehilangan pekerjaan atau mengalami PHK. Jadi, ada kekosongan regulasi yang mengatur orang kehilangan pekerjaan. Nah, saat ini, setelah kita memiliki program JKP, kita mengembalikan hakikat JHT sebagai jaminan sosial hari tua,” kata Ida dalam rilisnya.
Pertanyaannya, mengapa saat Permenaker Nomor 2/2022 sudah diundangkan, tapi JKP belum efektif? Program JKP ini, lanjut Ida, sudah berjalan dengan dibayarkannya modal awal dan iuran peserta dari pemerintah sebesar Rp6 triliun dan Rp823 miliar. Untuk manfaat JKP lainnya, Kemnaker juga sudah menyiapkan akses informasi pasar kerja lewat Pasker.ID serta menyiapkan lembaga-lembaga pelatihan untuk melaksanakan pelatihan reskilling maupun upskilling.
Dalam dialognya, Ida menerangkan bahwa Permenaker Nomor 2 Tahun 2022 yang diundangkan pada 4 Februari akan diberlakukan secara resmi pada 4 Mei 2022. Permenaker 2/2002 ini menjadi momentum untuk memberikan perlindungan paripurna bagi pekerja atau buruh di masa tua maupun pensiun. Di lain sisi, untuk risiko PHK, saat ini sudah terdapat program JKP.
“Pada masa transisi ini, kami akan fokus untuk menggencarkan sosialisasi setidaknya pada 3 aspek. Pertama, ketiga manfaat JKP, yakni uang tunai, pelatihan kerja, dan akses informasi pasar kerja. Kedua, maksud dan tujuan Permenaker 2/2022 untuk melindungi risiko masa tua atau pensiun pekerja maupun buruh. Ketiga, imbauan kepada perusahaan untuk menghindari PHK. Jikapun PHK harus dilakukan, hak-hak pekerja atau buruh harus ditunaikan, baik itu pesangon, uang penghargaan masa kerja, maupun uang penggantian hak. Jika tidak, sanksi tegas menunggu,” terangnya.
Dengan mendengar penjelasan Menaker, pimpinan SP atau SB cukup memahami, tapi juga menyampaikan beberapa aspirasi terkait dengan hadirnya Permenaker 02/2022. Ida menyimak dan mendengar secara serius terhadap masukan-masukan tersebut.
“Kami sangat mengapresiasi terhadap masukan-masukan tersebut dan akan kita jadikan bahan kajian,” tegasnya.
Sebagaimana dipahami, pandemi covid-19 telah berdampak serius terhadap dunia ketenagakerjaan, tapi upaya pemulihan ekonomi mulai menunjukkan hasil positif.
“Kita tentu harus optimis pemulihan ekonomi dan kesehatan semakin membaik sehingga risiko pemutusan hubungan kerja akibat pandemi kian menurun. Semoga pertumbuhan ekonomi kian terdongkrak, serapan tenaga kerja dari investasi juga terus meningkat,” ujar Ida.
Pada kesempatan itu, Presiden Konfederasi Serikat Buruh Seluruh Indonesia (KSBSI) Elly Rosita Silaban menegaskan pihaknya memilih berkomunikasi dan berinteraksi langsung dengan Menaker jika dibandingkan dengan membawa massa, tapi tak bertemu dengan pimpinan Kemnaker.
“Dalam pertemuan tadi, setiap federasi bebas mengeluarkan pendapat dan dijawab satu persatu, termasuk kami kritik Permenaker 2/2022 dengan usulan draf Permenaker yang dianggap KSBSI ada beberapa pasal tak sesuai dengan Permenaker sebelumnya,“ kata Elly.
Elly menilai kritikan kepada Ida melalui dialog merupakan strategi yang lebih elegan. Meski demikian, pihaknya tak menyalahkan teman-teman serikat pekerja atau serikat buruh yang melakukan aksi demonstrasi saat ini.
“Paling tidak ini merupakan strategi kalau kita ingin melakukan pertemuan tatap muka. Ini langkah paling pas,” katanya.
Hal sama juga disampaikan Presiden Asosiasi Serikat Pekerja Indonesia (Aspek Indonesia/federasi yang tergabung dalam KSPI) Mirah Sumirat. Mirah memberikan apresiasi atas sikap Ida yang menerima KSPI.
